E-Sign Consent Agreement


 Please read the following information carefully, by proceeding forward and signing this document you are agreeing that you have reviewed the following consumer disclosure information and consent to transact business using electronic communications, to receive notices and disclosures electronically, and to utilize electronic signatures in lieu of using paper documents. 

Introduction 

The E-SIGN Consent Agreement (“Agreement”) allows us to provide you with electronic versions of important notices, disclosures and documents associated with transacting business with Cumberland Valley National Bank and Trust Company. Certain laws and regulations require us to provide notices and disclosures to you in “writing” (traditionally this is defined as a paper notice); with your consent, the E-SIGN Act allows us to provide these documents to you electronically. 

Definitions 

  • The words “we”, “us," and "CVNB" means Cumberland Valley National Bank & Trust Company, affiliates, successors, and assigns. 
  • The words “you” and “your” means the person giving this Electronic Signature Consent, and also each additional account owner, authorized signer, authorized representative, delegate, product owner and/or service user identified on any CVNB Product that you apply for, use or access. 
  • “Electronic Signature Service” refers to the electronic delivery communication system used to deliver and electronically sign documents. 
  • "Access Device” means any electronic device you use to access your account and view electronic documents. This includes, but is not limited to: a traditional computer such as a desktop or laptop computer; or a mobile device such as a tablet or a smartphone. 
  • “Sending Party” refers to the individual affiliated with Cumberland Valley National Bank, that initiated the Electronic Signature Service. 


Scope of this Agreement 

By checking the box “I Agree to the Consumer Disclosure” and clicking on the “Accept” button at the bottom of this page, you agree to receive electronic notices, disclosures, and to sign electronic signature documents with all related and identified documents and disclosures provided to you over the course of your relationship with CVNB. 

You are not required to receive notices and disclosures or sign documents electronically. If you prefer not to do so, you may request to receive paper copies and withdraw your consent at any time as described below. 

Your Option to Receive Paper Copies 

You are not required to receive notices or disclosures or sign documents electronically and may request paper copies of documents or disclosures if you prefer to do so. 

You also have the ability to download and print any open or signed documents sent to you through the Electronic Signature Service using the PDF and Print icons. Adobe may also email you a PDF copy of all agreements you sign using the Electronic Signature Service. 

If you wish to receive paper copies in lieu of electronic documents you may close this web browser and request paper copies from CVNB by contacting the sending party at 1-800-999-3126. We will not charge you a fee for requesting paper copies related to this electronic communication. 

System Requirements 

By consenting to this agreement, you confirm that your Access Device meets the minimum specifications and requirement necessary to view and retain your electronic documents. You may access System Requirements for Adobe Sign® by visiting the following website: https://helpx.adobe.com/sign/system-requirements.html 

To access electronic documents on a computer, you will need: 

  • A connection to the Internet, using a current Browser version as defined below: Microsoft Windows 10 using Microsoft Edge, or a current version of Firefox, or Chrome 
  • Microsoft Windows 8 using a current version of Firefox, or Chrome 
  • Mac OS X v11 or later using Safari 7 or later, or a current version of Firefox, or Chrome 
  • A current version of a program that accurately reads and displays PDF files (such as Adobe® Acrobat® Reader). 
  • A computer and an operating system capable of supporting all of the above. 
  • An active email address. 

To access electronic documents on a mobile device, you will need: 

A mobile device with any of the following operating systems:
  • Android: Latest version and up to two versions back is supported. 
  • iOS (iPhone): Latest version and up to one version back is supported. 
  • A data plan provided by your wireless carrier and an up-to-date mobile internet browser that is compatible with, and supported by your operating system (such as Chrome or Safari). 
  • A current version of a program that accurately reads and displays PDF files (such as Adobe® Acrobat® Reader). 
  • An active email address. 

Note: 

By “Current Version,” we mean a version of the software that is currently being supported by its publisher. 

Additional System Requirements 

You will also need a printer if you wish to print out and retain records on paper, and/or electronic storage if you wish to retain records in electronic form. 

Maintaining a Valid Email Address 

It is important that you maintain a valid email address so that we may contact you regarding your account. You agree to maintain a valid email address and property notify us of any changes to your email address. You may update your email address through your CVNB Online Banking Account or by contacting us at 1-800-999-3126. 

Withdrawal Consent 

To withdraw your consent, simply exit this session prior to accepting this Agreement. You may request to receive paper documents in lieu of electronic documents, by contacting the Sending Party at 1-800-999-3126. 

Acceptance 

By checking the box “I Agree to the Consumer Disclosure” and clicking on the “Accept” button below, you acknowledge your acceptance of these terms and agree to sign documents electronically. You are also confirming that your Access Device meets the system requirements described above, that you have demonstrated your ability to receive, retain and view electronic documents on your Access Device, and that you have an active and valid email address.
